PRIVACY POLICY

This is the Privacy Policy for the web site and portal located at www.wellnessinteractive.net (the “Site”) owned by Wellness Interactive, Inc. (“Wellness Interactive”). By accessing the Site, you expressly consent and agree to the terms and conditions of this Privacy Policy, as well as to the Terms of Use including our use and disclosure of your personal information in accordance with this Privacy Policy. If you do not agree, then please do not use or access our Site. Throughout this policy, “you” as a visitor and user of the Site are referred to herein as a “user”.

Wellness Interactive is committed to protecting our users’ information and to making our users aware of our practices regarding the privacy of their information. This Privacy Policy guides our collection, storage and use of our Site users’ information.

Information Collected

Wellness Interactive shall only collect personally-identifiable information to the extent reasonably necessary for legitimate business purposes. From users of the Site, Wellness Interactive collects:

1. The domain names and IP addresses of users’ web browsers.

2. Information on what users access, utilize or visit.

3. Information voluntarily provided by you to Wellness Interactive, include contact information for distribution of newsletters, alerts regarding events and other such information unless, at the time of your Site visit, you request that such information not be stored.

Wellness Interactive may also receive information about users from other sources and add it to its account information about those users.

How the Information is Used

Wellness Interactive may use the information you give it to provide services to you or provide information and notices that Wellness Interactive thinks you may find interesting or useful. You may choose to opt out of any such distributions by using the opt out mechanism that is provided or by sending by certified mail to Wellness Interactive a written opt out election to the attention of Desiree Watson.

Emails Users Send to Wellness Interactive

This Privacy Policy does not apply to content, business information, ideas, concepts or inventions that users send to Wellness Interactive by email. If you want to keep content or business information, ideas, concepts or inventions private or proprietary, do not send them in an email to Wellness Interactive.

Message Boards, Portal to Professionals and Other Public Forums

As a service to our users, Wellness Interactive features message boards, chat rooms and other public forums and portals to resources on health and wellness where users with similar interests or medical conditions or concerns can share information and support one another or where users can post questions for experts to answer. Wellness Interactive also offers online discussions moderated by health and wellness experts. Any information shared or revealed (including personally identifiable and personal health information) by a user in a chat room, message board, professional postings, portals or online discussion is intended to be open to the public and is not a private, secure service. Users must carefully consider the impact on them and others before disclosing any personally identifiable or personal health information in any public forum. All information that User reveals or shares in these public forums may be seen, disclosed to or collected by third parties and may be used by others in ways Wellness Interactive is unable to control or predict, including, to contact you for unauthorized purposes. As with any public forum on any site, this information may also appear in third-party search engines like Alta Vista, Ask, Google, MSN, Yahoo, etc.

External Distribution of Personallyâ€‘Identifiable Information and of Confidential Information.

Subject to the public forums discussed above, Wellness Interactive does not externally distribute personally-identifiable information that is provided by our web site users, except if a user, customer or potential customer specifically opts-in that certain of its personally-identifiable information may be distributed to a third party. Further, external distribution does not include certain limited distributions such as sharing personally-identifiable information with a third party working on behalf of Wellness Interactive, transfer of personally-identifiable information in connection with the sale of Wellness Interactive’s assets or the merger of Wellness Interactive or the disclosure of personally-identifiable information in connection with legal proceedings, investigations of crimes, or other governmental investigations. Transferring personally-identifiable information in connection with a sale or merger and sharing personally-identifiable information with an entity or person working on behalf of Wellness Interactive is considered an Onward Transfer to third parties and will be handled as described below.

Onward Transfer

Wellness Interactive shall only make Onward Transfers of personally-identifiable information provided by a user of the Site (i) in connection with a sale of assets of Wellness Interactive or a merger involving Wellness Interactive or (ii) to a third party working on behalf of or providing services to Wellness Interactive. Any such Onward Transfer shall be limited to third parties that (i) subscribe to the safe harbor principles of the U.S. Department of Commerce or are subject to the European Commission’s Directive on Data Protection, or (ii) have entered into a written agreement with Wellness Interactive requiring that such third party provides at least the same level of privacy protection as is required by such safe harbor principles.

Use of Cookies

Wellness Interactive uses “cookies”. “Cookies” are elements of data that a web site can send to a user’s browser and store on a user’s computer. Cookies can note that a user’s browser was used to visit certain sites or pages on a certain date. Wellness Interactive uses cookies to enhance navigation and functionality of the Site. Wellness Interactive also uses cookies to let it know how visitors are using the Site, so that it can improve the Site and a user’s experience on it.

Use of Client Information: In Case of Litigation.

Wellness Interactive may also use user information to respond to a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency; to establish or exercise legal rights; to defend against legal claims; or as otherwise required by law. In such cases, Wellness Interactive may raise or waive any legal objection or right available to Wellness Interactive. When Wellness Interactive believes disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of its company, its users, employees, or others; to comply with applicable law or cooperate with law enforcement; and/or to enforce Wellness Interactive’s Site terms and conditions or other agreements or policies.

User’s Choice Not to Provide Personal Information.

Users can choose not to provide Wellness Interactive with certain information, but that may result in User being unable to use certain features of the Site because such information may be required in order for a user to obtain services on or through the Site.

Children

Wellness Interactive is committed to protecting the privacy of children. Neither Wellness Interactive nor any of its services are designed or intended to attract children under the age of 13. Wellness Interactive does not collect personally identifiable information from any person Wellness Interactive actually knows is under the age of 13. A parent or guardian, however, may use the Site to seek guidance for his/her minor son or daughter. The parent or guardian is solely responsible for providing supervision of the minor’s use of the Site, including the interactive portals, chat rooms and other dialogue areas on the Site. The parent or guardian assumes full responsibility for ensuring that the information he or she makes available regarding his or her child is kept secure and that the information submitted is accurate. The parent or guardian also assumes full responsibility for the interpretation and use of any information or suggestions provided through Wellness Interactive and the professional portal for the minor.

Security

Wellness Interactive uses appropriate safeguards to protect the security, integrity and privacy of personally-identifiable information provided to Wellness Interactive by users of the Site.

Atlhough Wellness Interactive takes (and will require our third-party providers to take) reasonable security precautions with respect to your personally-identifiable information collected from or stored on the site, WELLNESS INTERACTIVE CANNOT guarantee that any of your personally-identifiable information stored on the site’s servers or transmitted to or from the site, will be free from unatuhorized access. Wellness Interactive disclaims and shall have no liability for any loss of, unauthorized access or damage to, or interception of any of your personally-identifiable information being transmitted to or from the site or stored on the Site’s servers.

Access; Review and Correction

Users can, by eâ€‘mailing Wellness Interactive at info@wellnessinteractive.com, review and correct the personallyâ€‘identifiable information that has been collected from them by Wellness Interactive. Users should also report to such e-mail address any improper collection or misuse of information provided on the Site.

Links

The Site may provide links to other Internet sites that Wellness Interactive thinks you will find interesting or useful. Wellness Interactive is not responsible for the privacy practices of these other sites.

Wellness Interactive does not disclose users’ personal information to these third party websites without obtaining the users’ consent. Wellness Interactive does not endorse and is not responsible for the privacy practices of these sites. If a user chooses to link to one of these third party web sites, the user should review the privacy policy posted on this other website to understand how that third party web site collects and uses the users’ personally identifiable information.

Third Parties.

Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information Wellness Interactive collects from a user. If a user discloses his/her information to others, whether they are other users, professionals in the health and wellness field on the Site or accessed through the portal on the Site or through other Links, different rules may apply to their use or disclosure of the information a user discloses to them. Wellness Interactive encourages its users to ask questions before a user discloses his/her personal information to others.

Binding Agreement; Changes

Any user that accesses all or any part of the Site agrees that such user is at least eighteen years old and has agreed to this Privacy Policy. Each time a user accesses the Site, this Privacy Policy should be reviewed because Wellness Interactive reserves the right to change this Privacy Policy from time to time and the revised Privacy Policy shall become effective and govern the use of the Site within ten days of such revised Privacy Policy being initially posted on the Site.

By accessing the Site, you agree that any dispute with respect to privacy is subject to this Privacy Policy and the Terms and Conditions of the Site, including that the governing law with respect to any dispute in New Jersey and that any and all claims are subject to the limitations on damages.
