WELLNESS SUCCESS STORY CONTEST (“Contest”)

OFFICIAL RULES

NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN.  MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  NEW JERSEY LAW GOVERNS THIS CONTEST.  VOID WHERE RESTRICTED OR PROHIBITED BY LAW.

WHO MAY ENTER: This Contest is open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older with Internet access at the time of entry.  Only entrants logging onto the Internet from within the 50 United States and the District of Columbia are eligible to enter the Contest.  Anyone who is not a legal United States resident and physically located within the United States at the time of entry may not participate.  The following persons are not eligible to enter the Contest: (a) employees of Wellness Interactive, Inc., a New Jersey corporation with principle offices located at 14 South Orange Avenue, Suite 1R, South Orange, New Jersey 07079 (“Sponsor”), its parents, affiliates, subsidiaries, divisions, officers, employees, advertising or promotion agencies; (b) officers, employees or agents of any organizations directly involved with this Contest, including any co-sponsor of the Contest; (c) immediate family members and persons living in the same household as the persons identified in (a) and (b) above.  This Contest is subject to New Jersey law.  Void where prohibited or restricted by law.

HOW TO ENTER: This Contest begins at 12:00 a.m. E.S.T. on April 25 and ends at 11:59 p.m. E.S.T. on June 25 (“Entry Period”).  For purposes of this Contest, “receipt” of an e-mail entry occurs when Sponsor’s servers record the e-mail information resulting from the entrant’s e-mail having been received.  This Contest will consist of a single round and there is no fee to enter.  Entrants can submit their wellness success story for this Contest in one way.  E-mail Entry: e-mail your success story, told in 500 words or less, along with your name and preferred mailing address, to contest@wellnessinteracive.com.  Each e-mail entrant must be the authorized account holder of the e-mail account by which the entry is made.  All entries become the property of Sponsor and will not be returned or released.  All winners must meet the eligibility requirements set forth in these Official Rules in order to qualify as a winner or for any prize.  Limit one entry per person during the Entry Period.  Multiple entries submitted by a single person are void.  Incomplete entries are void.  By entering, entrants acknowledge compliance with these Official Rules.

Neither Sponsor nor its service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any website or online service, or any other error or malfunction, or late, lost, illegible or misdirected entries.  Entry materials that have been tampered with or altered are void.

ODDS OF WINNING: The actual odds of winning will depend on the actual number of entries received for this Contest.

JUDGING: All stories will be judged by a panel of 4 qualified judges, and such judges will be selected by Sponsor.  Tracy Gray Hair (Writer), Marcia A. Harris (M.D), Karen Lee (Wellness Consultant), Toni Brown (Cancer survivor).The wellness success stories will be judged on a 100 point scale.  The wellness success stories will be judged based on the following criteria, each of which is followed by its relative weight in the final scoring: embodiment of the four core beliefs of Sponsor (available at http://www.wellnessinteractive.com/aboutus.html) (35 points); quality of wellness success storyline (30 points); severity of odds overcome in achieving success (20 points); creativity (10 points); prose (5 points).  Each individual qualified judge will score each entry once (from 1-100 on the above described scale).  Each entry’s final score will be the average of the 4 qualified judges’ scorings.

If any of the top ten individual scores are shared by two or more wellness success stories, these tied stories will be ranked by a consensus of the 4 qualified judges, from best to worst, based solely on each story’s relative merit in the most heavily weighted of the judging criteria above (i.e. embodiment of the four core beliefs of Sponsor) (this process will be known as the “Tie-Break Judging”).  The highest ranked story of those previously tied stories will be deemed the winner of the contested slot in the top ten wellness success stories.  The other previously tied stories will then occupy their corresponding number of slots both inside and outside of the top ten wellness success stories, starting with the slot immediately after the contested slot, based upon their ranking in the Tie-Break Judging.  The stories that previously occupied that/those subsequent slot(s) will be forced down in the rankings accordingly.  Any stories forced into rankings below the top ten (i.e. eleven, twelve, etc.) as a result of this Tie-Break Judging, will no longer be considered part of the top ten wellness success stories.  This process shall be repeated for any and all ties that may appear in the top ten wellness success stories.

The final ranking of the top ten wellness success stories will include no more than ten stories.  The top ten ranked wellness success stories will be posted on http://www.wellnessinteractive.com/, with each of these ten stories individually appearing on this website for a period of approximately seven days, over a total of approximately seventy days.  The three stories ranked first, second and third will be eligible to receive prizes, in accordance with these Official Rules.

PRIZES: (1) Grand Prize: one Apple iPod Nano and one Wellness Lounge Kit (Approximate Combined Retail Value: $214.00).  (2) Second Prize: one Wellness Lounge Kit and one issue of the WL magazine (Approximate Combined Retail Value: $71).  (3) Third Prize: one issue of the WL magazine. All prizes will be awarded in the form stated herein.  Redemption subject to terms and conditions of these Official Rules.  No substitution or transfer of prizes permitted and prizes have no cash redemption or equivalent value.  Total retail value of all prizes: $285.  Approximately 13.000 Contest print solicitation pieces will be distributed in addition to the posting of this Contest on http://wellnessinteractive.com/.  Taxes are the sole responsibility of winners.  Only the prizes specified above will be awarded.  Sponsor, its affiliates and their agencies and employees expressly disclaim any responsibility or liability for injury, loss or damage of any kind to any person or property relating to the delivery, acceptance and/or subsequent use of prizes awarded.  Sponsor makes no representations or warranties concerning the appearance, safety or performance of any prizes awarded.

Sponsor disclaims all warranties, express or implied, including without limitation any implied warranties of merchantability or fitness for a particular purpose as to the quality or operation of the Grand Prize awarded hereunder.  Sponsor’s sole obligation shall be to pass on to the Grand Prize winner any manufacturer warranties available for the Grand Prize.

WINNERS: A list of winners will be published at www.wellnessinteractive.com/, and each of the ten winners will be notified individually, by e-mail and/or standard mail, sent to each entrant’s previously provided preferred mailing address, on or about July 10.  As a condition of winning the prizes, grand, second and third prize winners will each be required to complete and sign an affidavit of eligibility/publicity and liability release, where permitted by law, and return them, and any other applicable forms required by a taxing authority, properly executed, within fourteen (14) days of notification.

Further, by accepting the prize, the winner consents to Sponsor’s use of their name, photograph and/or likeness, address, voice, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and Internet), for all legitimate business purposes including advertising and promotional activities, without additional compensation, unless prohibited by law.

If any correspondence of Sponsor or any prize is returned as undeliverable, the corresponding prize will be forfeited and will be awarded to an alternate winner.  Should a winner make any false statement in any document referenced in these Official Rules, the winner will be required to promptly return to Sponsor his/her prize.  Any unclaimed prize will be awarded to the next eligible entrant with the next highest ranking after that of the winner who failed to claim such prize.  Prize must be claimed by July 20 or an alternate winner will be selected.  Sponsor reserves the right to verify eligibility qualifications of any winner.  All properly claimed prizes will be awarded.  Limit one prize per person.

In case of a dispute as to the identity of any e-mail entrant, entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry.  As used in these Official Rules, “authorized account holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider, or other organization (e.g. business, educational, institution, etc.) responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.  Any potential winner may be requested to provide Sponsor with proof that such winner is the authorized account holder of the e-mail address associated with the winning entry.

To obtain a list of prize winners, available after June 25, contact Sponsor at contest@wellnessinteractive.com.  Requests received after July 25 will not be honored.

PRIVACY NOTICE: Sponsor will be collecting personal data about entrants in accordance with its privacy policy.  Please review Sponsor’s privacy policy at http://wellnessinteractive.com/privacy.html.  By participating in the Contest, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.  Entrants may receive marketing materials and other communications from Sponsor and affiliated or other companies whose products and services Sponsor feels might interest entrants at a future date.  An entrant not interested in receiving this material, should go to contest@wellnessinteractive.com and notify Sponsor of entrant’s desire not to receive such materials.  Sponsor will honor all such notifications within sixty (60) days.

USE OF ENTRIES: Sponsor shall have the right to use all entries submitted in the Contest, whether an entry is a winning entry, and by entering into the Contest and submitting his/her story, each entrant is expressly hereby agreeing to the use and republication of each entry on Sponsor’s websites(s), in Sponsors publications and in other marketing and promotional materials produced by Sponsor, in each case without an compensation or consideration therefor being due and owing to each entrant.  If you do not want your story shared in this manner, do not enter this Contest.

LIMITATION OF LIABILITY: Participation in this Contest constitutes understanding and acceptance of each and all of these Official Rules and regulations.  By participating, entrants fully and unconditionally acknowledge such understanding and acceptance and agree to abide by and be bound by these Official Rules and regulations.  All Federal, State and local laws apply.  Prizes are not transferable unless otherwise noted.  By acceptance of the prize, winner agrees to the use of his/her name, and/or likeness for the purpose of advertising or trade without further compensation.  All of these rules and regulations are subject to the sole interpretation of Sponsor, in its sole discretion.  Any decisions of Sponsor with respect to any and all of the rules and regulations shall be final and binding on all entrants.  Any dispute or situation not covered by the Official Rules will be resolved by Sponsor in a manner Sponsor deems fairest to all concerned and that decision shall be final and binding on all entrants.  By participating in this promotion, entrants agree to release and hold harmless Sponsor, its parent companies, subsidiaries, affiliates and related entities and their respective directors, officers, employees and agents (collectively, “Released Parties”) from and against any claim and/or cause of action arising out of participation in this promotion or the receipt or use of any prize from this promotion.

Released Parties are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Contest, including any injury or damage to entrant or any other person’s computer relating to or resulting from participating in this Contest or downloading any materials in this Contest.

To the fullest extent permitted by applicable law, under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, and entrants further waive all rights to have damages multiplied or increased.

MISCELLANEOUS: If, for any reason, the Contest is not capable of running as planned including infection by computer virus, bugs, tampering, hacking, flaming, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the sponsor, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and commence judging of all eligible entries received prior to the cause or causes of such cancellation, termination, modification or suspension.  Should the Contest be terminated prior to the end of the stated Entry Period, notice will be posted at www.wellnessinteractive.com/.  Any attempt to deliberately damage the content or operation of this Contest is unlawful, subject to legal action by Sponsor or its agents, and will result in immediate disqualification from the Contest.  Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors.

CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with this Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of New Jersey, without regard to New Jersey conflict of law principles. 

IF THE STATE IN WHICH YOU RESIDE, OR FROM WHICH YOU SUBMIT YOUR ENTRY FOR THIS CONTEST PROHIBITS THESE TYPES OF CONTESTS, THEN ANY ENTRY FROM YOUR STATE WILL BE INELIGIBLE FOR PARTICIPATION IN THIS CONTEST AND WILL NOT BE ELIGIBLE TO BE CONSIDER FOR THE PRIZES.

CONTEST RULES: These Official Rules will be posted on Sponsor’s website at http://wellnessinteractive.com/ during the Contest Period.  Copies of the Official Rules may also be obtained by writing to Sponsor.
